Accuro Trademarks

A trademark can be a word, phrase, symbol, or design that distinguishes the source of the goods or services. Also, as trade dress, it can be the appearance of a product or its packaging, including size, shape, color, texture, graphics, and appearance (e.g, retail store or website).

The following is a non-exhaustive list of Accuro’s trademarks and service marks.

When using the marks in publications that will be distributed only in the United States, include the appropriate ™, ℠, or ® symbol on first use. For publications that will be distributed outside the United States, do not include trademark symbols. Instead use the appropriate trademark attribution notice, for example: Accuro and Accuro Repellency are trademarks of Apple Inc., registered in the U.S. and other countries.

The list also includes a suggested generic term for each trademark. For all publications, include an appropriate generic term after the trademark the first time it appears. Thereafter, the generic term should appear frequently with the trademark. (These generic terms are only suggestions, and there may be other words that are equally appropriate.)

Trademarks are adjectives, and should not be made into verbs or made plural or possessive.

The absence of a product or service name or logo from this list does not constitute a waiver of Accuro’s trademark or other intellectual property rights concerning that name or logo.

Rights and Permissions

If you have any questions concerning the use of Accuro trademarks and/or the licensing of Accuro copyrighted material (e.g., photographs, video footage, Accuro advertisements or other Accuro materials), please complete the online form.

For use of Accuro copyrighted material in third party works (e.g., books or publications), if applicable, please include the information below. Please note that upon receipt of your request, we may require additional information.

Unsolicited Idea Submission Policy

Accuro AgriServices, Inc. (“Accuro”) and its employees and contractors do not accept, review or consider any unsolicited ideas, works, materials, proposals, suggestions, artwork, content or the like, including for advertising campaigns, promotions, products, services, technologies, product enhancements, processes, marketing strategies, product names, content or creative materials (all of the foregoing “submissions”). Please do not send or provide any submissions in any form to Accuro or any of its employees or contractors.

The purpose of this policy is to avoid potential misunderstandings or disputes when Accuro’s products, services, technologies, advertising, promotions, marketing strategies or content might seem similar to submissions provided to Accuro. If, despite our request that you not send us your submissions, you still submit them, then regardless of what your correspondence says, the following terms will apply to your submissions.

Terms of Idea Submission

You agree that: (1) your submissions and their contents along with related intellectual property rights will automatically become the property of Accuro, without any compensation to you; (2) Accuro may use or redistribute the submissions and their contents for any purpose and in any way on an unrestricted basis; (3) there is no obligation for Accuro to review the submissions; and (4) there is no obligation to keep any submissions confidential.

Product Feedback

Accuro does, however, welcome your feedback regarding many areas of Accuro’s existing business. If you want to send us feedback, we request that you use the forms located at www.accuroag.com/contact, where you can choose from the many listed areas for your feedback. Please provide only specific feedback on Accuro’s existing products, services and marketing strategies using those forms; and do not send or provide any submissions other than using those forms.

Feedback and Information

Any feedback you provide at this site will be deemed to be non-confidential and not proprietary. Accuro will be free to use and redistribute such information on an unrestricted basis, without any compensation to you.

Guidelines for Using Accuro Trademarks and Copyrights

These guidelines are for Accuro licensees, authorized resellers, developers, customers, and other parties wishing to use Accuro’s trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of the Accuro Logo for commercial purposes without the prior written consent of Accuro may constitute trademark infringement and unfair competition in violation of federal and state laws. Use of Accuro trademarks may be prohibited, unless expressly authorized.

If you are a licensee of an Accuro trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines. If you are an Accuro Authorized Reseller or member of an Accuro program, you may be subject to additional restrictions.

Accuro’s trademarks, service marks, trade names, and trade dress are valuable assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using an Accuro trademark, in whole or in part, you are acknowledging that Accuro is the sole owner of the trademark and promising that you will not interfere with Accuro’s rights in the trademark, including challenging Accuro’s use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any Accuro trademark. The goodwill derived from using any part of an Accuro trademark exclusively inures to the benefit of and belongs to Accuro. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. If you have any questions regarding these guidelines, please talk to your Accuro representative or submit your query to Accuro’s Trademark Department.

Authorized Use of Accuro Trademarks

1. Advertising, Promotional, and Sales Materials: Only Accuro and its authorized resellers and licensees may use the Accuro Logo in advertising, promotional, and sales materials. Such authorized parties may use the Accuro Logo only as specified in their agreement with Accuro and any associated Guidelines and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with Accuro. 2. Compatibility: Developers may use Accuro, Accuro Repellency, Caretakers of Repellency, or any other Accuro word mark (but not the Accuro Logo or other Accuro-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced Accuro product, provided they comply with the following requirements.

a. The Accuro word mark is not part of the product name.

b. The Accuro word mark is used in a referential phrase such as “runs on,” “for use with,” “for,” or “compatible with.”

c. The Accuro word mark appears less prominent than the product name.

d. The product is in fact compatible with, or otherwise works with, the referenced Accuro product.

e. The reference to Accuro does not create a sense of endorsement, sponsorship, or false association with Accuro or Accuro products or services.

f. The use does not show Accuro or its products in a false or derogatory light.

3. Publications, Seminars, and Conferences: You may use an Accuro word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

a. The use is referential and less prominent than the rest of the title. Acceptable: XYZ CONFERENCE for Insecticide Users.

b. The use reflects favorably on both Accuro and Accuro products or services.

c. Your name and logo appear more prominent than the Accuro word mark on all printed materials related to the publication, seminar or conference.

d. The Accuro logo or any other Accuro-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from Accuro.

e. A disclaimer of sponsorship, affiliation, or endorsement by Accuro, similar to the following, is included on the publication and on all related printed materials: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by Accuro AgriServices, Inc.”

f. A trademark attribution notice is included in the credit section giving notice of Accuro’s ownership of its trademark(s). Please refer to the section below titled “Proper Trademark Notice and Attribution.”

4. Web Sites: Web sites that serve only as noncommercial electronic informational forums concerning an Accuro product or service may use the appropriate Accuro word mark, provided such use complies with the guidelines set forth in Section 3 above.

5. Accuro Web Badge Licensing Program: Web sites may use one of the Accuro Web Badges if  you comply with the terms of the Accuro Web Badges License Agreement and Guidelines. For more information see Accuro Web Badges.

Unauthorized Use of Accuro Trademarks

1. Company, Product, or Service Name: You may not use or register, in whole or in part, Accuro, Accuro Repellency, Caretakers of Repellency, or any other Accuro trademark, including Accuro-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

2. Accuro Logo and Accuro-owned Graphic Symbols: You may not use the Accuro Logo or any other Accuro-owned graphic symbol, logo, or icon on or in connection with web sites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from Accuro, such as a reseller agreement.

3. Variations, Takeoffs or Abbreviations: You may not use a knock off image of the Accuro Infinity Circle or other variation of the Accuro Infinity Circle logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of an Accuro trademark for any purpose. For example:

4. Disparaging Manner: You may not use an Accuro trademark or any other Accuro-owned graphic symbol, logo, or icon in a disparaging manner.

5. Endorsement or Sponsorship: You may not use Accuro, Accuro Repellency, Caretakers of Repellency or any other Accuro trademark, including Accuro-owned graphic symbols/logos, or icons, in a manner that would imply Accuro’s affiliation with or endorsement, sponsorship, or support of a third party product or service.

6. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing Accuro, Accuro Repellency, Caretakers of Repellency or any other Accuro trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from Accuro.

7. Accuro’s Trade Dress: You may not imitate the distinctive Accuro packaging, web site design, logos, or typefaces.

8. Slogans and Taglines: You may not use or imitate an Accuro slogan or tagline.

For example: “Caretakers of Repellency.”

9. Domain Names: You may not use an identical or virtually identical Accuro trademark as a second level domain name.

Not acceptable:    “accuro.com”     “accurorepel.com”     “accuro-repellency.com”     “accuromarket.com”

The Resin Trademark

1. You may not use the Accuro trademark standing alone except to denote or refer to the Accuro product line.

2. You may use “Accuro” in your product name, company name, trade name, or service name provided your name satisfies the following criteria:

a. Your product is not a insect repellent, insecticide, fungicide, or bactericide.

b. Your product is Accuro compatible or the third party business is associated with Accuro based products or services.

c. “Accuro” is used in combination with another non-generic or non-geographically-descriptive word.

Acceptable:   AccuroSpray      AccuroWipe

Not acceptable:   AccuroDetroit      AccuroSales

d. “Accuro” does not appear more prominently than the rest of the name in size, color, or typeface.

e. Your name does not suggest a false association with Accuro.

f. Your name is not confusingly similar to any trademark owned or used by Accuro.

g. You acknowledge that Accuro is the sole owner of the Accuro trademark’s and that you will not interfere with Accuro’s use or registration of trademark’s alone or in combination with other words.

h. If you are an Accuro Authorized Reseller or member of an Accuro program, you may be subject to additional restrictions.

Rules for Proper Use of Accuro Trademarks

1. Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service.

2. As adjectives, trademarks may not be used in the plural or possessive form.

Correct: I bought two Accuro products.

Not Correct: I bought two Accuros.

3. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that. For a list of suggested generic terms please contact Accuro’s Trademark Department.

4. Always spell and capitalize Accuro’s trademarks exactly as they are described. Do not shorten or abbreviate Accuro product names. Do not make up names that contain Accuro trademarks.

Proper Trademark Notice and Attribution

1. Distribution Within the United States Only

a. On product, product documentation, or other product communications that will be distributed only in the United States, use the appropriate trademark symbol (TM, SM, ®) the first time the Accuro trademark appears in the text of the advertisement, brochure, or other material.

b. Contact Accuro’s Trademark Department for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark.

c. Include an attribution of Accuro’s ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.

Following are the correct formats:

2. Distribution Outside the United States:

a. Do not use trademark symbols on products, product documentation, or other product communications that will be distributed outside the United States.

b. Use one of the following international credit notices:

_________ is a trademark of Accuro AgriServices, Inc.

Depictions of Accuro Products

1. Endorsement or Sponsorship: Accuro does not support the use of its logos, company names, product names, or images of Accuro products by other parties in marketing, promotional or advertising materials as their use may create the perception that Accuro endorses or sponsors the product, service or promotion.

2. Compatibility: If you are a manufacturer of spraying, misting, fogging or wiping systems, you may show an image of an Accuro product in your promotional/advertising materials to depict that your company is in agreement with, or otherwise works with, Accuro products or services, provided you comply with the following requirements:

a. Your product is in fact compatible with, or otherwise works with, the referenced Accuro product.

b. The image is an actual photograph of the genuine Accuro product and not an artist’s rendering (Note: You must obtain express written permission from Accuro before using any photograph owned or licensed by Accuro).

c. The Accuro product is shown only in the best light, in a manner or context that reflects favorably on the Accuro products and on Accuro AgriServices, Inc.

d. The reference to Accuro does not create a sense of endorsement or sponsorship by, or other false association with, Accuro or Accuro products.
